is near the shell oil refinery. we have an update coming up. preparations for may day are being made across the bay area and across the country. the protests planned against recent ice raids. good morning and thank you for joining us on "mornings on 2". it is tuesday morning may 1. i am pam cook. >> i am dave clark. in martinez a train derailed near the shell oil refinery. it happened near marina vista avenue and shall avenue. -- shell avenue. it is believed that the train was backing into the shell refinery when it went off the rails. it is not off of the track itself, but at least the rails. it is about two cars. we have some cruise -- crews

out here. they say they are not with the railroad. we don't know how long it will take to fix it. it appears two cars have their wheels off of the rails. they are leaning into the other tracks. luckily, this is not a hazmat situation. there does not appear to be any sign of a leak. we have only seen two workers out here. there is one police officer. the rail line runs next to the amtrak line. no word yes -- get on if those commuter trains will be affected this morning. you are taking a look at some of the earlier video we have out here. it looks like it is just two tankers that have gone off the rails. again, we don't know if this will be a situation that will take a long time. it is not too far from highway 680. it is not far from downtown martinez. it does not appear to be a hazmat situation. there are no signs of any leaks. we are not exactly sure how long this will take, but so far no reported injuries. >> that is good. let's check in with sal

castendo , who knows the area well. >> i don't think it will affect traffic. that area is not affected. i don't think it will affect motor traffic, it could affect train traffic, but not cars. let's look at the commute, westbound 580. as you drive through it is slow on the ultimate pass -- altamont pass on 205 and 580. it looks like the roadways, the speeds, you can tell held deep the red is, it is about 15 miles per hour. what you get into livermore, it looks good. we have slowed traffic approaching the dublin interchange on westbound 580.

give yourself extra time. if you're driving on interstate 880, traffic is moving okay. there are no major issues driving through. traffic looks pretty good passing the colosseum. if you're driving to the bay bridge toll plaza, it looks good. there have been no major problems as you drive in this area. let's go back to the desk. >> you can go to me, south. it is all right. >> i am so used to going to the desk. for mostly clear, patchy low clouds but temperatures will come up with the northerly breeze. a low will form in southern california. there was shower activity in napa county yesterday. we are not expecting that today. it could move a little to the south, but yesterday the weather to what the models said it would do. here is another system dropping down from the pacific northwest. 30s, 40s and 50s. gilroy 42, a lot of 40s, low 40s in the santa cruz mountains at 42 in southern california.

this will give them some rain. this system will start off sunny, except for some patchy, low clouds. temperatures are in the 60s and 70s. we have a northerly wind. we get up to 75 degrees. cement oakland police are busy searching for a killer. two people were shot and killed last night. it happened at 89th avenue and international just after 9:30 pm. when shooting victim was found in the street. the second victim reportedly was found nearby inside of a car. there is no word about sussex -- suspect so what may have led to the shooting. there was more shaking in the east bay this morning. a 2.6 earthquake hit east of

danville. there are no reports of any damage at this point, but it comes a day after 3.3 earthquake hit this area. in the past few days there have been nearly a dozen earthquakes in the area and about 60 so far this year. quite a swarm of quakes we are watching for your. san jose police broke up a street gang they believe is responsible for several violent crimes. >> most of the people arrested were juveniles. the suspects who are accused are accused of robberies, burglaries and carjackings. >> reporter: 16 individuals, these five adults and the rest are juveniles face a laundry list of crimes. police say they are tied to at least seven robberies, six carjackings and burglaries. >> we have cases where shots were fired. we are glad to get them in custody before there was a more serious injury. >> reporter: eight of them are already in custody from a bust in january. that bust led to new evidence a new arrests. police say it is not your

traditional gang. >> instead of having a rival gang to fight with, their method of operation is committing robberies, burglaries and carjackings. >> it is good that it will not happen to anyone else. to this was a victim last month. police say teenaged victims followed them home. they are happy to hear about these arrests. >> when i came here in 1975 it was very peaceful. >> reporter: in december, police swarmed this neighborhood south of downtown san jose. the home is tied to one of the suspects. >> they are just trying to pinpoint somebody. there trying to pinpoint my brother. >> reporter: she says her 18- year-old brother has never been in a gang. >> i strongly believe there is no reason for him to be in this. he was doing nothing wrong. >> reporter: this mother says her 16-year-old son was also

arrested and claims he is innocent. >> i don't know. i am just confused right now. i haven't seen oprah. they haven't show me no proof. police say seven guns were recovered along with other stolen property. the adults are being held in the main county jail. the juveniles are in the county juvenile detention center. facebook's annual f8 developers conference start later this morning. developers from around the world will be at san jose's mchenry convention center for the two-day event. virtual reality, artificial intelligence and augmented reality are expected to be big topics. ceo mark zuckerberg is set to begin the keynote address at 10 am this morning. it will be his first major speech before -- since testifying before congress. today's the first day of may. may day rallies are planned all over the bay area. may 1 is known as international workers day. demonstrators will

march for various causes. somewhere rally for workers rights and higher pay, others will be protesting president trump's immigration policies and recent immigration raids. interstate 80 is open after a crash that injured four people and a chp officer. that crash happened just before 4 pm yesterday afternoon in the eastbound direction just before red top road. it crippled the evening commute. a chp cruiser was parked on the shoulder of the highway when it was hit from behind by all- white mitsubishi. police say witnesses reported that car had been driving erratically and quickly changing lanes then going into the shoulder. the chp says the officer suffered minor injuries. the three people in the other car suffered major injuries. traffic heading east toward fairfield and sacramento was backed up for miles yesterday evening. the highway patrol says the accident offers a reminder for drivers. >> it is the move over law. if you see them on the shoulder, watch out for it.

>> after the crash, officers found a pet rabbit hiding under the drivers seat of the mitsubishi. it is unclear at the rabbit was a factor in the crash. the chp says the bunny has been reunited with its owner. caltrans is starting a project that will shut down lanes overnight on interstate 80 and konta counter -- they will fix the freeway between richmond and hercules. there will be some eastbound and westbound lane closures monday through friday between 8:30 pm and 4:30 am. caltrans says the work should be finished in early november. cement police in santa rosa are checking surveillance video of an armed robbery. it happened sunday night at the shell gas station on college avenue. a gunman walked in and got away with an unknown amount of cash. then he got into a waiting red

four-door car that police believe might be a late 90s chevy lumina. a reward of $2500 is being offered for information leading to an arrest and conviction of the people in that robbery. the case for the man suspected of being the golden state killer might have to move out of sacramento. we are learning how the use of the dna database to identify the suspect is expected to have a ripple effect around the state. that migrant caravan is still at the border but some of the participants have made it into the united states. i am in washington and will have more about the ongoing debate coming up. we have traffic moving along pretty well at the maccarthur maze. we will look at the south bay commute coming up.

welcome back to "mornings on 2". actress ashley judd is suing movie producer harvey weinstein, claiming sexual harassment and violations of california's unfair competition law. she says her career almost ended because weinstein spread lies about her when she turned on his sexual advances. movie director peter jackson claims weinstein told him ashley judd was difficult and a nightmare to work with. jackson says that made him take

her off the list of actresses he was casting for hers -- for his lord of the ring movies. weinstein denies he tried to hurt ashley judd's career. a departure from a company. he did not elaborate on his reasons for leaving, saying it was time to move on. the washington post reports he is planning to resign from facebook's board of directors, as well. special counsel robert mueller has reportedly a list of questions he wants to as president trump. the new york times says it obtained a list of 48 questions on several subjects, including the firings of fbi director james comey and his first national security advisor, michael flynn. there are also reportedly questions about his treatment of attorney general jeff sessions and what the president knew about a meeting at trump tower between his campaign and the russians. they were offering dirt on hillary clinton allegedly.

many of the questions appear to focus on whether the president obstructed justice, even though the investigation should be focused on the russian investigation. no response from the white house. about 200 california national guard members are expected to arrive at the california-mexico border this week. under the agreement with the trump administration, the troops will crackdown on gangs, human traffickers and weapons and drug smugglers. the guard members will not help enforce immigration laws or help in the construction of a border wall. there deployment is set to run through september. asylum-seekers from the migrant caravan making its way to mexico have begun to enter the united states. >> after some delays in processing, handful of the immigrants have been allowed to go in, over the objections of president trump. we are live from washington with the very latest on all of

this. >> reporter: the administration has argued that the caravan, they think, is undermining u. s. law. some of these individuals have been successful so far, at least in entering the country. they are in the country this morning. a celebration at the border as migrants formed a massive caravan that began to enter the united states from mexico. >> [ speaking spanish ] >> reporter: we are happy says this migrant. they are waiting to apply for political asylum in the united states. some have made it through, but some have also been arrested for criminal illegal entry. either way, the standoff at the border is

reaching a resolution. for trump, who appeared in the rose garden with the president of nigeria yesterday, the caravan is evidence of a broken immigration system. >> we have to have borders. if we don't have borders, we don't have a country. i have been watching for weeks as the caravan came up. we are doing the best we can with it. we have to have changes in congress. we have to have it quickly. >> reporter: vice president mike pence visited the border yesterday to underscore that message. the reality is that most asylum- seekers are ultimately turned down but they can remain in the country for years as the cases move forward. this caravan has become a test of wills. immigrants who claim refugee status under international law versus a president who is made reforming a trouble border a central goal. the justice department has been talking about sending more immigration judges to the border to try to speed up the process. they want to get rid of some the backlog. >> a quick question. what will happen to the asylum- seekers who were not allowed into the u. s. right now lacks -- right now?

>> reporter: it is a process to get these individuals through to make those initial claims and ascertain if they have a valid case to move forward. it will take some time to get the others to remain on the mexican side of the border through. that is a process where they claim asylum. let's check in with south. i had people asking me on twitter about this train development. -- train derailment. you don't think it will affect traffic. >> it doesn't look like it will affect traffic, especially on the main roadways. what may happen is you might see some media attention or some attention that might slow people down or who are slowing down to look at it. this will not have a major effect on the roadways near the

refinery in richmond. let's go to the gilroy commute. right now we are looking at traffic from gilroy to san jose. this will commute is getting busier but it is not stop and go right now. we have a couple of roadways, 129 we see slowing as you head over to 101. 101 itself looks good to say martin and morgan hill as you drive into the main part of the valley. the valley looks pretty good. you can get a good commute in the valley. there is no problem in 280 in san jose getting to highway 17. at the bay bridge, we have a little bit of a backup. this is about the time the metering lights going on. i would not say it is too crowded. you can see the bay bridge has a moderate delay. let's go to mr. steve paulson. >> thank you, mr. sal castendo. it is cold out there under mostly clear skies. there are some low clouds dancing around. jamie is out in oakland. a cool 52 is the chill. happy may day. thank you. antioch is 54 and pittsburg is 52. 44 in black hawk, pleasanton ,

welcome back to "mornings on 2". the trump administration is delaying a decision to impose new tariffs on steel and aluminum imports from canada, mexico and the european union for at least 30 days. back in march, the u. s. announced a 25% tariff on imported steel and a 10% tariff on aluminum. canada and mexico were expected to be exempt from the tariffs, which were due to start today. the trump administration says it has a deal with south korea on steel imports. back here at home, we make it to vote in november on california's gas tax. an effort to repeal the gas tax now has more than 900,000 signatures to put the question on the ballot. those signatures will be delivered today. organizers say the new $0.12 per gallon tax to pay for road repairs was passed without voter approval. state transportation officials

announced $2.6 billion in mass transit improvements paid for in part by the tax hikes. critics say the gas tax could jeopardize construction projects all over the state. the ceo of one of the world's biggest software companies gave a speech for students at skyline high school in oakland. bill mcdermott, head of sap, talk to the students about his personal journey to success in the tech industry. he says he is trying to reach a younger, more diverse workforce and getting teenagers interested in tech before they go to college is important. >> we are trying to get our company younger by one year every year. we are trying to bring in nutella from all corners of the earth. you do that by opening up the conversation, especially in schools like this, before young people get to universities. two years ago, sap-year-old donated $400,000 to skyline high school and berkeley city college. they were able to give the students 34 brand-new computers

wednesday and then after cold thursday morning it will be sunny and warmer. i think the fog will start to creep back by sunday is a weak system brushes us. after cool monday, 62 in oakland, 67 today. livermore only 64 yesterday, 72 today. san jose, 66 to 70. we had thunderstorm activity pop up yesterday afternoon in napa county. there is a possibility of that happening later today, but more likely to the south as a low is forming in southern california. that will give them rain later on. 36 in lake worth, 42 at the napa airport, 45 in livermore. southern california will have a low develop today. that will play into our weather with sun this afternoon and partly cloudy this afternoon -- sun this morning and partly cloudy this afternoon. we are starting in solano county, but we do touch on the bay bridge. right now traffic is moving

along pretty well on 80 westbound. as you drive from vacaville, fairfield into vallejo there is a little bit of slowing in vallejo approaching the carquinez bridge. there is slowing on 37 as you head west toward sonoma and marin county. at the maccarthur maze traffic looks good coming around the corner to the bay bridge toll plaza. the metering lights are on and traffic is backed up. we are following that developing story out of martinez where a freight train derailed near the shell oil refinery. we are out there on the scene. it happened early this morning near marina vista avenue andrea -- shell avenue. it does not appear any oil is leaking. this is a live video right now of the scene. reporter leigh martinez is out there. it is believed that the train was backing into the shell refinery when it came off the

tracks. the rail line runs next to amtrak and union pacific lines. so far, no word on any commuter trains affected by this. train once leigh martinez is out at the scene and will give us an update in just a minute. caltrans crews are making progress in big sur right along the pacific coast where highway 1 was completely blocked last may with a huge rock slide. officials say it will reopen by the middle of september. more than 1 million tons of rock and earth tumbled off the hillside, covering a quarter mile of the roadway just north of san luis obispo county. >> caltrans crews say they are tired of cleaning up homeless camps from the freeways, rants and overpasses across the state. the union filed a formal grievance with caltrans.

the complaint says the crews get little safety training for what is considered hazardous work. to cleaning up homeless camps is often dangerous for the crews tasked with doing the job. often the ground is a muddy, slippery, debris red in place with things dangerous to touch. >> pcs, urine, penermon products and all kinds of things on the ground, needles, syringes, they use buckets, five gallon buckets for toilets. >> reporter: that is to say nothing of the open hostility that often comes from those being affected. >> sometimes they have pitbulls in there. they will let the dogs loose to

chase the caltrans workers out. >> reporter: that is why the caltrans maintenance union, the international union of operating engineers filed an official grievance. caltrans issued this statement. statement -- safety is a top priority for caltrans and we will carefully review the grievance. >> their job is to maintain the highways and freeways. that is filling the potholes, striping the lines and installing the guard rails and trimming the bushes, trees and shrubs along the highway. their job is not to clean a homeless camp. >> reporter: they have a point about their own safety, but we can clean up and clean out as many homeless camps as we want, but that is not getting at the root cause of homelessness. seemed caltrans, the city of oakland, the mayor, they need to get together like they do on their little projects. >> reporter: until then, melvin samper, on the street for four years, say some dumpsters at camps would be used. >> they could put the garbage in there and wait for the city or caltrans to pick them up. took to the typical enough takes two or three days. in the last five years they spent $30 million to clean up homeless camps, 10 million of that last year alone, money that should've gone to road

maintenance. president trump says he would consider meeting with north korean dictator kim jong un inside the demilitarized zone between north and south korea. a meeting between the two leaders is expected to happen in late may or early june. on sunday, north korea said it would abandon its nuclear program at the u. s. agrees not to invade. national security adviser john bolton says north korea has made similar pledges before with little intention of following through. >> i think that is what denuclearization means. we will want to test north korea in this first meeting for evidence they have made that strategic decision. >> there are some positive signs of tensions easing between north and south korea. south korea says it is turning off its propaganda broadcasting loudspeakers at the border and north korea is shifting his time zone 30 minutes earlier to line up with the south.

the trial for the man accused of being the golden state killer may be moved out of sacramento county. joseph deangelo still has not entered a plea to several counts of murder, but the district attorney says she is open to a change of venue for his trial. joseph deangelo is facing charges in at least four counties, sacramento, ventura, orange and santa barbara counties. da anne marie schubert believe there should be just one trial in one jurisdiction. >> ultimately, at least from my perspective, the goal is that we try to do these in one county because of logistics, because of resources, because of victim sensitivity. >> she will meet with officials in the three other counties and say s the final decision may be made in the next month. the defense may also ask for a

change of venue. joseph deangelo is due back in court on may 14. >> since joseph deangelo's arrest, there's been a growing interest by law enforcement agencies in using genealogy sites to help solve cold cases. authorities in sacramento said they got a match by using a free, florida-based genealogy site. that does not mean dna from every cold case will get the same treatment, especially because of privacy and legal concerns. while many in law enforcement are excited about the possibilities, others have their doubts. >> it has been a game changer. we are in unchartered waters in regards to using this technology. there are some naysayers. >> nobody is looking at their science. nobody is looking at the labs to see if they are nice and clean. are they using the correct procedures? >> local officials say they plan to consult with the da's office, the state and the fbi before moving forward. police say very few homicides are solved with dna, especially

since most crimes don't have a dna trail to follow. agencies are also hoping that one day they can use these open source due knowledge he cites to help identify unknown victims. for almost all of the candidates for mayor of san francisco debated last night at the form of the league of women voters and entered a variety of questions. >> one of the leading contenders, london breed was not there. her campaign spokeswoman said she had a scheduling conflict. we were there to hear from the other candidates. >> reporter: about one month until the special election for mayor and monday night seven candidates battled for votes at the league of women voters form. a poll in mid april showed former senator mark leno had a 29% lead. monday he called for more local hiring from tech companies and taking landlords

work on transportation issues and cracked down on people dumping elite -- illegally. >> they will be fined and after two or three fines, there will be more serious acts as far as the law is concerned. >> reporter: republican richie greenburg says his concern is families will no longer be able to afford living in the city and holding a fema style triage for homeless people. >> we went to bring the homeless to that location so they are off the streets and safer and warm and clean. they can be triaged for those who are mentally ill. >> reporter: some faces were not so familiar. michelle bravo says the mayor needs to be held accountable. >> the lack of transparency, the behavior in city hall has not worked. >> reporter: ellen zell says she is running against government construction -- corruption.

two oakland city councilmembers will ask the full city council to join a lawsuit against the national football league and the owner of the raiders. the issue is the raiders moving to las vegas. the council members will talk about legal options at the council meeting tonight. the city may try to stop the raiders from relocating or force mark davis to leave the

raiders name and logo in oakland. reuben foster will be back in court next week after a plea hearing on domestic violence was delayed. the santa clara da's office asked for more time to review new evidence in the case. in february, his ex-girlfriend accused him of punching her and rupturing her eardrum. she claims she is hurt -- he claimed she was hurt during a fight with another woman. that information has been handed over to the da's office for review. game two against the pelicans begins tonight and steph curry will likely make a comeback for the warriors. it is been five weeks since he sprained his left knee. he missed 15 games but the coach says he is ready to be out on the cart. the warriors one game one. tonight's series begins at 7:30

welcome back to "mornings on 2". the santa clara district attorney's office is issuing a warning about a band of roving criminals targeting senior citizens. they are known for distraction burglaries. that is when one person pretends to be from a utility company or a repair service. they make up a reason to get into a home or yard. while one member of the group distracts the homeowner, the other goes around and gets into the home and looks for valuables. >> it is pretty easy to fake all that stuff. they have vague credentials or something. i would be careful. >> we are pretty trusting, especially if they have a

clipboard and they look like they will be helpful or they are asking for money or donations. >> authorities say to be cautious and always check the id of any service provider trying to enter your home. commuters at two bart stations in san francisco are being greeted by elevator attendant who will help keep those bart stations clean and safe. they will be on duty at the civic center and the powell street stations when they are open. they are not out there to clean up or enforce the law, but they do have radios and panic buttons, if there is a problem. the city will monitor how often the elevators are used and how often cleanup is needed. all of that information will be used to decide if the program will be extended past november. a failed vote -- a sailboat that ran aground in pacifica will be on the beach for another day. the weather did not cooperate. it ran aground when it's motor failed. four people and a dog was on board. one woman suffered a broken
